TERMS & CONDITIONS DRESS BY MILA
1. Identity of Dress by Mila

2.1 These general conditions apply to all offers, agreements and deliveries of Dress by Mila.
2.2 By ordering, the customer accepts the applicability of these conditions.
2.3 Changes and additions to provisions of these terms and conditions and/or further agreements only apply if they have been confirmed in writing by Dress by Mila.
3. The agreement
3.1 The agreement is concluded at the moment of acceptance by the customer of the offer and the fulfilment of the associated conditions.
3.2 If the customer has accepted the offer electronically, Dress by Mila confirms the receipt of the acceptance of the offer electronically. As long as the receipt of this acceptance has not been confirmed, the customer can dissolve the agreement.
3.3 The agreement is only concluded after acceptance of the order by Dress by Mila. Dress by Mila is entitled to refuse orders or to attach certain conditions to the delivery, unless explicitly stated otherwise. If an order is not accepted (e.g. due to previous fraud or a credit check) Dress by Mila will inform the customer within 3 working days after receipt of the order.
4. Prices and payment
4.1 All prices mentioned on our website are in euros and include VAT.
4.2 Shipping costs are not included in the mentioned prices.
4.3 All prices on the website are subject to input, typing or printing errors. No liability is accepted for the consequences of the above-mentioned errors.
4.4 The price of an article cannot be changed within the duration of the agreement.
4.5 Payment via the website is made via iDeal (The Netherlands), Bancontact (Belgium) or credit card.
4.6 When the customer buys a product during a period in which no sales promotion applies, the customer is not eligible for a discount afterwards.
4.7 Discount codes or codes for free shipping of orders do not apply to items that already benefit from a discount.
4.8 When payment for the order is not made within 5 working days from the date of the order, the order will be cancelled.
4.9 Payment of the order takes place as agreed in the agreement. The order will only be shipped once the payment has been made in full.
5. Delivery and execution
5.1 After an order has been placed, the customer will receive a confirmation e-mail as soon as possible. This order confirmation will state the purchase price of the product(s) and the shipping costs. If the customer does not receive a confirmation after the order has been placed, the customer should inform us by sending an e- mail: email@example.com
5.2 Dress by Mila will take the greatest possible care when receiving and executing orders.
5.3 The customer must provide Dress by Mila with the correct address and e-mail address. Any changes to this must also be passed on to Dress by Mila in a timely manner. If the client has given a wrong address for the delivery, then the extra shipping costs are for the account of the client.
5.4 Delivery takes place while stocks last.
5.5 Dress by Mila is not liable for damage as a result of exceeding delivery times.
5.6 If the delivery is delayed – either by being temporarily out of stock, or for other reasons – or if an order cannot be carried out or can only be carried out partially, the customer will be notified.
5.7 Dress by Mila will execute orders within 30 days at the latest. If this is not possible (for example because the ordered product is not (anymore) in stock or no longer available), or there is a delay for other reasons, or an order cannot or only partially be carried out) then the customer will receive a message within 30 days after the order has been placed. In this case, the customer has the right to dissolve the agreement free of charge. After dissolution Dress by Mila will refund the amount paid by the client within 7 working days.
5.8 Articles will be delivered to the delivery address as stated by the customer at the time of the order. The risk of loss or damage to the articles is transferred to the customer at the moment that the articles are delivered to the customer.
5.9 If the customer refuses or fails to receive the product, Dress by Mila reserves the right to charge the reasonable costs of storing the products to the customer until the moment that delivery can be made. If the delivery fails for a reason beyond Dress by Mila’s control, Dress by Mila reserves the right to terminate the agreement and refund the amounts paid minus the reasonable costs incurred.
6. Exchange and return
6.1 When purchasing articles, the customer has the possibility to dissolve the agreement for a period of 14 days. This period commences on the day following receipt of the item by or on behalf of the customer.
6.2 During this period, the customer will handle the article and the packaging with care. The customer will only unpack or use the item to the extent necessary to assess whether the customer wishes to keep the item.
6.3 If the customer wants to exchange an article, the customer must return the current article and place a new order in the webshop of Dress by Mila.
6.4 The client is obliged, before proceeding to return, to report this in writing to Dress by Mila within the period of 7 working days after delivery. The customer must prove that the delivered items have been returned on time, for example by means of a proof of postal delivery. The return of the delivered items is at the expense and risk of the customer. If the customer has not returned the delivered items to Dress by Mila after this period has expired, the agreement can no longer be terminated.
6.5 Insufficient or unstamped returns will not be accepted by Dress by Mila, regardless of the reason for the return. Unwarranted returns will be returned to the customer with deduction of the shipping costs.
6.6 For return shipments the following conditions apply: Return of the products must take place in the original or similar solid packaging. The products must be in their original condition, i.e. unworn, undamaged, including the attached label. If these conditions are not met, the right to terminate the agreement expires.
6.7 Return shipments are at the risk of the buyer. This means that Dress by Mila is not liable for the damage and/or loss of returned items.
6.8 After an article has been returned in good condition, Dress by Mila will transfer the amount to be returned to the bank account of the client within 7 working days. If the client returns the entire order, the client will receive the purchase price including the corresponding shipping costs. If the customer returns a part of the order, the customer will only receive the purchase price back.

7.1 The customer is obliged to inspect the products immediately after delivery. Defects, missing or wrong products that the customer has discovered or should have discovered during the inspection must be reported to Dress by Mila as soon as possible but at the latest within 10 days after the delivery.
7.2 Dress by Mila guarantees for 30 days that the products comply with the agreement, the specifications mentioned in the offer, the reasonable requirements of reliability and/or usability and the existing legal provisions and/or government regulations on the date of the conclusion of the agreement.
7.3 The aforementioned guarantee does not apply if any defect has arisen as a result of improper use or if, without prior written permission from Dress by Mila, the customer and/or third parties have made changes or tried to make changes to the product, the product has been used for (abnormal) purposes for which it is not intended, has otherwise been handled carelessly or in conflict with the instructions of Dress by Mila.
7.4 The provisions in these conditions regarding guarantee do not affect the guarantee claims of the customer under the law, all with due observance of the provisions in these conditions and the agreement, including the nature and quality of what has been sold and delivered to the customer.
7.5 The client is obliged to give Dress by Mila the opportunity to examine (or have examined) the observed defects. If the delivered products show defects, Dress by Mila will, at its discretion, replace or repair the delivered products free of charge or make a refund of an amount to be determined in consultation with the client. This amount will always be limited to at most the invoice amount of the product(s) concerned.
8.1 Any liability of Dress by Mila, of staff and products of Dress by Mila for all damage, of any nature whatsoever, directly or indirectly, including business damage, consequential damage, damage to movable or immovable property or to persons, is expressly excluded. Neither is Dress by Mila liable for the damage caused by third parties in the execution of the agreement.
8.2 Dress by Mila accepts no liability for any damage resulting from the use of the products of Dress by Mila.
8.3 Any liability of Dress by Mila towards the buyer is in any case limited to at most the invoice amount that the buyer owes Dress by Mila under the relevant agreement.
10. Applicable law
Dutch law shall apply on all agreements and all non-contractual obligations between Dress by Mila and the customer.
